After seeing the Eternal Boy episode I wonder why it wasn't released in the US. It DID involve Peter Pan, but really mostly the THEME of it, and it was Capt'n Hooks character that was mostly 'borrowed'. Thing is, Sony or Tezuka could have released it as is in the US, and if Disney said anything about it they could have played the 'Lion King' card. "You sue me, I'll sue you right back!"

Rule of thumb: when you are not a giant, you don't try to get in the way of a giant :d oh: Disney has a whole department of lawyers, I don't think Tezuka has
Sony does have one, but can't play the "Lion King" card, and certainly isn't interested in waging a war for a single episode

I think that whole "sued by Disney" thing was an excuse. The dubbers never liked showing Astro as a kid or vulnerable in any way. Preferring to just make him a generic super hero. This episode was full of that sort of thing so they skipped it saying "If anyone asks, we'll say Disney threatened to sue." Think about it. If that's the case, why is the episode mentioned in the PS2 game?

Now that I do think about it, this seems to be more likely. They found the episode unnecessary for their purposes, so they omitted it entirely. It's a common practice with anime localization, so I shouldn't be so surprised...
